HUD Changes

We have been relaying you information regarding changes to the BUD rules and we understand that Joyce Sine with the Housing Assistance Office has also mailed out some information. There apparently is a possibility that the new lead regulations can be delayed until March 15, 200 1 if the municipality can certify that there are not enough trained
and licensed personnel in the area to take care of the work required. If you are a BUD Landlord and agree that there are not enough trained people, please contact Joyce direct and request that Cumberland apply for this extension.

September Meeting

Our September meeting was held on the night of the big rain and flood in Cumberland and was cut short because ALOC President, JeffHutter, had to leave to take care of flooding in the basement ofhis home on Bedford Road. Fortunately
the flooding was very minor and there was no damage. However the rest of Cumberland, in particular the west and north sides of Cumberland were not so lucky.

The damages involved many homes and businesses and it is thought that the rainfall exceeded 4 inches within the couple of hours. The City of Cumberland is trying to determine the exact amount ofrainfall, as they believe, as do most ofus, that this was a 100 or 500-year event that is difficult for anybody to predict.

When the meeting was cut short it was during the
procedures for eviction and how to work with the courts. We will attempt to start over in October and the paper mailed to members will be discussed in full detail.

Insurance Coverage

When many Cumberland residents in the Fayette-Green - Paca Street area had damages due to the heavy rains on September II, 2000 the first thing they thought of was their insurance companies. Unfortunately many of these people did not have flood insurance or riders to cover the backing up of the sewers and or storm drains.

The bottom line is that very few of these people will be receiving compensation from their insurance companies. Considering the severity of the problem it is probably a good idea for all of us to re-examine our insurance policies to make sure we that we have adequate coverage. The cost of some of the extra riders mentioned above may be very
small, especially the one regarding the backing up of sewers and storm drains.

 

Cumberland Flood Relief

TWR and HereinTown.Net is conducting a Flood Relief fund raising campaign to help the people that were flooded out by the recent deluge that occurred on September II th.

More details are included on the attached flyer and ALOC members should consider making a donation to this fund to help out our neighbors on the West Side.

MDE Registration and etc.

Some of our members have questioned the registration policies and procedures of the MDE and we have looked into the matter and we have some answers.

Back in the early 90's the MDE sent out papers to most rental property owners, which had a $ 2.00 registration fee for each unit. This was apparently used to fund the initial Lead Paint Commission that was exploring what to do with the lead paint problem. Some have confused this with the later registration fees of$ 10.00, which were imposed in 1994 and 1995 as stipulated by lIB 760. If you remember this legislation when passed was to take effect in 1995 but was delayed because the MDE could not get the regulations completed unti11996.

Please keep in mind that it will soon be time to register your units with the MDE. We should soon see paperwork for this renewal that should be sent to the MDE before the end of the calendar year.

Include within HB 760 was a provision that all units, regardless of whether they are occupied or not must eventually receive the full risk reduction treatment. The first benchmark will be reached on February 24,2001 when we will be required to have at least 50% of our rental units in compliance with the risk reduction standard. By February 24,2006 100% of all rental units must meet the standard.

Also keep in mind that all tenants must be receiving copies of the various lead paint brochures every 2 years and there are Federal disclosure requirements under Title X that must also be met. ALOC has sent members details regarding these items in past mailings.



Maryland Property Owners Notes

The Maryland Property Owners Network will soon resume its meeting schedule in the next month or so in preparation for the 200 I legislative session. At this time we do not know of any bills that are planned for action that may adversely affect the investment
property owner, but there is obviously plenty of time and plenty of nuts that will be looking to put together some whacked out bills.

From talking with our counterparts in Baltimore we understand that they expect to see some wacky bills submitted that would be zeroed in on local matters in Baltimore. At the next MPON meeting we will probably receive more details. While these bills may not affect us much at this time, they can eventually filter through the legislative and regulatory process and end up being imposed statewide. Oh what a lovely, business friendly state to live in!

ALOC ' s President J efT Butter has been selected to be part of the committee that is to make recommendations to the Allegany County Commissioners regarding increasing the present 3 commissioners to 5. A recent poll ran on HereinTown.Net's website showed
overwhelming support for increasing the commissioners to 5. If you have access to a computer you need to follow these polls, which run every week or two. Some of the comments are hilarious. Also many are very well thought out and presented. Unfortunately many of these people do not use their grammar or spell checkers. Oh well, it's the thought that counts! Leases and other Documents

The Leases and other forms have been upgraded to reflect Law changes made in recent years and are available now.

ALOC has available leases, rental applications and tenant checklists for sale, at cost, to members. The cost for each item is as follows:
Lease @ $ 0.25 Rental Application @ $ 0.20 Move in Checklist @ $ 0.20 Lead Paint Brochures, both EPA and Maryland @ $ 1.50 for the pair.
Document Receipt for MDE and EPA brochures (disclosure) @ $ 0.15

These forms are kept at Jeff Hutter's office, TWR Comm. at 117-119 Valley Street. Any paid member can stop by and pick up whatever they need, however we ask that you call first with your order so that the forms can be ready and waiting for you.
